The Bullies Rule the School Award

From the Houston Chronicle
...An 8-year-old second-grader in Houston, Texas, who said he'd been bullied for months, reached his breaking point when two boys yanked down his pants in front of their class. The unidentified boy jumped from a school balcony. Fortunately, he survived the leap. The school made the boy sign a no suicide contract before his mother arrived promising not to try to harm himself again without first talking to a “caring and supportive adult” at home or school. The teacher aware of the bullying had met with his mother seven times and did nothing to stop it.

USA TODAY - A 'Watershed' Case

This is a great article:

...The Mohawk Central School District in Upstate New York agreed last week to do more to protect students from harassment as part of a settlement with a 15-year-old gay teenager who said he was bullied so relentlessly he had to change schools. The district also will pay his family $50,000 and cover the cost of counseling services.

In a landmark cyber-bullying case, a California state appeals court ruled last month that free speech doesn't protect legitimate-sounding threats online. The ruling supported a lawsuit by the father of a 15-year-old whose classmates at a Westlake prep school posted death threats and anti-gay rants on the boy's website.

What's the solution? Many experts say there's no substitute for a clear, vigorously enforced school policy on bullying, supplanted by periodic training of the entire staff, from guidance counselors to teachers and lunchroom workers.

Last month, the Massachusetts House and Senate passed different versions of anti-school bullying legislation that the regional office of the Anti-Defamation League says could emerge as the nation's strongest. It would not criminalize bullying, but could mandate an anti-bullying curriculum in schools; training of teachers and staff; and reporting of potentially criminal bullying to law enforcement.

NY State of Bullying: State Legislature rates 'F'

NY State of Bullying: State Legislature rates 'F' for laws to protect schoolkids: Bully Police

Wednesday, March 31st 2010, 2:19 PM

Bully Police, a national watchdog group, has given the Empire State its lowest possible grade for not passing a law to protect schoolkids from bullies.

It’s not that the state has buried its head in the sand. Legislators have been working on a bullying law for a full decade now. But it has yet to pass.

Why?...

Massachusetts, the 42nd state to get an anti bullying law?

I'm counting down the days - I don't think it will be long now and Massachusetts may have their law. Right now the law is in the reconciliation phase as both state houses have passed their versions of an anti bullying law. The governor has promised to sign the law.

So here's the good news. After reading Senate, No. 2323, AN ACT Relative to Bullying in Schools... It would be a pleasure to give them an A++ grade.

Way to go Massachusetts!!!

Bullied Student Wins $800K Settlement

by Tom Henderson - March 9th

Bullies everywhere are going to find it a lot harder to shove kids into lockers, trip them in hallways, call them degrading names and generally make every day at school a living hell.

That's because one victim didn't get mad. He got a lawyer.

Officials for Hudson Area Schools in Michigan were ordered March 3 by a federal jury to pay former student Dane Patterson $800,000 for failing to protect him from school bullies...

...Patterson tells the newspaper he complained to teachers and administrators, but nothing changed.

"I can't even put into words the pain and suffering that I went through for years," Patterson, now 19, tells the Free Press. "It's something that I would not want anyone else to go through."

The final straw, he says, came when he was a sophomore and a naked student rubbed against him in a locker room. ...

Boy's act of despair shocks school

Mother blames bullies after 8-year-old allegedly jumps off balcony in suicide try
By PEGGY O'HARE

March 27, 2010, 7:43AM

Houston's Blackshear Elementary School is tackling the difficult subjects of bullying and suicide with its student body after an 8-year-old boy repeatedly harassed by classmates allegedly jumped from a 2 ½-story campus balcony on Wednesday.

After being told to leave his classroom by a substitute teacher when two other boys pulled down his pants in front of the class, the second-grader leaped from the school's balcony in view of two other teachers and five students, community activist Quanell X said. Though some bushes broke his fall, preventing serious injury, the boy told school staff he was “tired” because the same students had bullied him for months and his teacher would not stop it, Quanell X said. The HISD Crisis Intervention Team was summoned to help the boy, who has dyslexia...

South Dakota Votes NO for Kids

Panel kills bill to require school bullying policy
http://www.argusleader.com/article/20090211/UPDATES/90211058/1001/NEWS

Well, it looks like South Dakota lawmakers don't care about their kids. Somehow they think they were elected to "delagate" to the schools to set their own anti bullying rules...like they believe the government-run schools will on their own? One can only pray that they care about anyone's safety in South Dakota... I don't know why I thought this, but I thought the number one job of our state and federal lawmakers was to protect it's citizens. Maybe in South Dakota kids aren't considered worthy to be considered citizens - they are 2nd class, I guess. ...Can you tell I'm disgusted? My comments in blue

Here's the article.
PIERRE – A legislative committee says bullying is a school and community problem that won’t be ended with state laws. (Yes, and car accidents won't be prevented with good roads and road signs)

The House Education Committee voted 11-3 on Wednesday to kill HB1279, which would have required every school board to develop a policy that prohibits bullying and harassment and provides safe ways for victims to report incidents. Supporters said school children sometimes stay away because they fear bullies. Uniform policies would help schools deal with the problem, they said. Opponents said the issue is a community one that state law won’t solve. (Opponents have never had to fight a school district living in la-la land - "bullying doesn't happen in our school")

Well, get ready South Dakota - you are going to see lawsuits against school districts instead of laws - a good law could have prevented the wave.

Bully Police USA has a new Co-Director

Kevin Epling has agreed to be the Bully Police USA Co-Director and serve with myself, Brenda High, to move BPUSA into the forfront of volunteerism and activism for the kids of America.

A little about Kevin...
Kevin is the father of Matt Epling, whose story is featured in the book, Bullycide in America: Moms speak out about the bullying/suicide connection. (This book can be found at http://www.bullycide.org/.)

After the loss of his son Matthew in the summer of 2002, forty days after a hazing incident, Kevin and Tammy Epling began to work for an anti-bullying law in Michigan. They want to make sure that children were safe from bullying, hazing and harassment in Michigan’s schools and that the trauma they endured would not happen to someone else. The law will be named "Matt's Safe School Law" in memory of their son.

Locally, Kevin and Tammy have led the charge to establish a community based awareness program: Safe Schools, Safe Communities.

The Eplings have been actively telling their story to numerous civic, educational and parent groups, have been featured on CNN, The Mitch Albom Show and several other local and regional news outlets. Kevin and Tammy have established an art competition for middle school students to explore the arts and assist in building self esteem

Kevin and Tammy also serve as Legislative Liaisons for Bully Police Michigan as well as doing some consulting and speaking engagements. Kevin can be contacted by email at kepling@gmail.com.

Supreme Court rules sexually harassed students may sue

Check out this new ruling today by the US Supreme Court - http://www.usatoday.com/news/washington/judicial/2009-01-21-supreme-court_N.htm

By Joan Biskupic, USA TODAY
WASHINGTON — The Supreme Court ruled unanimously Wednesday that students who are sexually harassed may sue under a federal statute covering schools and a broader civil rights law. The decision revives a lawsuit brought by the parents of a Massachusetts kindergartner who said a third-grade boy on her school bus repeatedly made her lift her dress, pull down her underwear and spread her legs.

Her parents, Lisa and Robert Fitzgerald, said officials in their Barnstable School district did not sufficiently address their complaints. The parents sued under Title IX of the Education Act Amendments of 1972, which bans discrimination at schools that receive federal funds, and under a long-standing civil rights law known as Section 1983, which protects against discrimination based on the Constitution's equality guarantee...

My Comments:
WOW this is incredible news!!!
There are two points I would like to comment on...
First that the school "...did not sufficiently address their complaints." This tells me that the schools had prior knowledge and did nothing. This is what ultimately won this case, because if the school had not known about the bullying/sexual harassment, they could have plead ignorance in the matter.
Second - the sexual nature of the complaint...
Parents who are trying to stop a child's bullying will need to think of ways to complain to schools that the bullying was sexual. That won’t be hard because the one term most widely used in bullying is “you’re gay” and “you’re fat”, etc.

This is big news for the rights of our children

Wisconsin's Proposed Law

Good news. Wisconsin is proposing an anti bullying law in 2009.

I’ve reviewed the proposed Wisconsin law and as it stands, I would give it a B+. Using www.BullyPolice.org/grade.html as my grading guide...

1) The word "bullying" is used in the text of the bill/law/statutes.

2) The law is clearly an anti bullying law, not a school safety law.

3) There is a requirement for definitions of bullying and harassment.

4) There are recommendations on how to make policy and what needs to be in the model policy.

½ point for number 5) A good law involves education specialists at all levels, starting with the State Superintendent's (Education) office.... but the law only goes this far and doesn't require buy-in with School Districts, Schools, Parents and Students.

6) This law mandates anti bullying programs

7) There is a date the model policy is due, when the schools need to have their policies in place. My only thought here is why the date is March 1, 2010 (and August 15, 2010 for School Boards). Is the Wisconsin State Dept of Ed notoriously slow at getting things done?

8) There is a requirement for protection against reprisal, retaliation or false accusation.

MISSING - 9) There must be school district protection against lawsuits upon compliance to policies.

MISSING - 10) A top rated law will put the emphasis on the victims of bullying by assigning counseling for victims who suffer for years after peer abuse.

½ point for number 11) This law does require mandatory posting and/or notification of policies and reporting procedures for students and parents.

MISSING - 12) Cyberbullying or "Electronic Harassment" law.

Cyberbullying - New law in California

Here is an article about the New California's Cyberbullying Law, AB 919 which Creates new "cyberbullying" penalties.

CA Enacts Laws Against Cyber Bullying KCBS - CA,USA - The new law will allow the state's public schools, as of January first, to suspend or expel students who are cyberbullies. ...A Pew Research Center study has found that about a third of teenagers say they have been annoyed or harassed online.

This brings California's grade up to a B+

California is now joining several other states who have recently enacted a cyberbullying, or electronic harassment clause inside anti bullying laws. Some of those states are Florida (A++ rating), Kentucky (A++ rating), Delaware (A++ rating) and Maryland (A++ rating). Others may have added a cyberbullying clause but I've not become aware of them yet. I know several states are talking about adding a cyberbullying clause to their laws.

The Case that Makes the Case for a Cyberbullying Law
One state, Missouri, may be taking action toward's a cyberbullying law this year because of the trial of Lori Drew. Apparently Drew actively conspired with two others in creating and maintaining a MySpace profile for a nonexistent 16-year-old boy named "Josh Evans" in September 2006. The Evans account was used by multiple people to flirt with, befriend and ultimately reject 13-year-old Megan Meier, who'd had a falling-out with Drew's daughter.
One of the users of the account, Ms. Grills, a then-18-year-old woman employed by Drew and her husband, has admitted to sending a final, cruel message to Meier while posing as Evans: "The world would be a better place without you. Have a shitty rest of your life." Meier then hanged herself in her bedroom.

Two possible new laws in 2009

...IT'S ABOUT TIME!
A state as beautiful as Massachusetts should have had an anti bullying law a long time ago. Just reading through the brief statement about this possible law (with a cyberbullying clause), gives me the opinion it will be an A++ law, but of course, I must see the text of the law first to make a final judgement. ...Here is the latest google alert about MA's possible law: SCHOOL BULLIES (H 5179) - The House gave initial approval to legislation requiring all public schools to develop and implement a plan to prevent bullying ... Wisconsin has a good chance this year - Anti-bullying bill gains steam in Wis. Legislature (http://www.chicagotribune.com/news/chi-ap-wi-schoolbullying,0,5847838.story), Chicago Tribune - MADISON, Wis. - An anti-bullying proposal that failed twice in the Legislature has newfound support and a better chance at being passed next year. A special committee of state lawmakers, school district employees, police and others wants to see the law enacted. The group studied school safety for five months this year and recommended that schools either follow state anti-bullying guidelines or come up with their own. It will be up to the Legislature to decide whether to put the recommendation into law.

Letter to Santa

Dear Santa,

We need your help! This year for Christmas all we are asking for is to feel safe in school and for the bullying and violence that we face everyday to stop! We hope this is not too much to ask for but we are being extra good this year in hopes that you could provide us with this only gift!

Love, ...All your little children who are being bullied at school

P.s. Calling All Santa’s Elf’s for this very important mission! Help us grant this Christmas wish. This is too big for even Santa to handle alone! Find out if your school district has an anti bullying policy and what they are doing so this Christmas wish will be delivered by Christmas. Tell him that all children deserve a safe place to learn because they cannot learn in fear!
Time is Running out, Christmas is almost here and the children will be disappointed ! Please pass this information to everyone you know!!

(A THANK YOU to Erica Taylor, New York, for her Santa letter)

Conference Call - Dec 7th

Back by popular demand!

John Halligan and I will be moderating another Conference Call on December 7th at 9:00 PM Eastern time (8: PM Central, 7: PM MST, 6: PM PST) on the topic - How to get an Anti Bullying Law passed in your State (and how to work with school districts who are not obeying their state laws). This call will be a Question & Answer session and will be an hour long. The last call was well attended. The only downside was that many people had questions but we ran out of time.

This call is open to ANY interested parent, activist, teacher or concerned individual who is not afraid to be heard in their community.

Besides learning some techniques about the “politics to stopping bullies”, we will have a chance to meet others around the USA who are trying to make a difference in their schools and State.

I will need an RSVP from anyone who plans to be on the call. We will fill the call at 75 participants. To avoid confusion on the call, please submit questions before the call so we can be prepared with the best answers to help you succeed in getting an anti bullying law and/or communicating with your lawmakers. The cost to you will be your normal long-distance rate, plus the investment of one hour of your time.

If you wish to join us, please press Reply and type in I will attend in the subject area – then send. There is no need to reply if you cannot attend the conference call.

Now that the elections are over, lawmakers are starting to put laws/bills together for submission to their education committees. Time is of the essence--It’s time to start bugging our lawmakers to move forward for the protection of bullied and abused kids.

I will send the conference call phone number and instructions this weekend and a reminder email on Monday to those who reply in the affirmative.

Hope to hear from you soon.

Gemma Lang (& Mom) Speaks - From the UK

Hi All,
Just a quick note to thank you for your lovely messages recently regarding the assaults and bullying I sustained here in the UK. I am just writing to give you a bit of good news really.
On Wednesday 17th November 2004 I finally became a Police Officer. I work as a voluntary police officer here in the UK but when I have completed my degree in law plan to work as a regular officer fullt ime for few year
However a little more exciting than that is on Friday November 19th 2004 I attended an awards ceremony. I have been a fianlist for Community Welsh Woman of the Year 2004. It was the most entered category and to have got to the final 3 at the age of just 19 I was stunned. The other fianlists were fully grown adults who had done wonderful things themselves. However, much to my surprise I won Community Welsh Woman of the Year 2004.
On the Monday was the first ever Anti Bullying week in the UK and I did both local and national interviews for press, including a live interview for Sky News. Also as I was a finalist for another award, including winning Supreme Volunteer of the Year back in March 2004 I have now been offered a 3 year fellowship with the RSA in London.
This is mainly being sent to let you know we're trying here in teh Uk to help stop bullying and maybe this can be an inspiration to your children, some of whom may still be victims. I was a victim until I was about 15. After 9 years of physcial and emotional torment by bullies I decided enough was enough and at 19 have been honoured with this award, but more than that have been able to make a difference. as we all try to do, it prevents our suffering from being in vane.
Anyway, shall let you all get on now as I'm sure your busy. Please get in touch if I can be of any help to you and I have also attached a picture for you to see from the awards night.
Best Wishes and take care,
Gemma Lang
(Founder of Full Stop 2 Bullying!, UK)
P.S. Please can you forward this to all members if it is the wrong email address please Brenda, many thanks. :-)

GEMMA'S MOM -
Dear Brenda,
I have read with interest the story of your wonderful son Jared and can only wonder and marvel at the strength you display when you keep fighting for a law which may help to bring an end to this heartbreaking and cruel problem of bullying.
I am Gemma's mum and follow with interest the fight in the USA to make bullying a crime. We support you all in your fight and only wish we were able to be there with you to lend our full support. As parents my husband and I can only cry for the anguish and despair that parents must suffer at the loss of their beloved child to bullying. Between 16 & 20 children will take their lives each year here in the U.K and just recently young Laura Rhodes ended her life following reports of her suffering at the hands of bullies. Gemma dedicated her award to Laura. Every child has the right to feel safe in the environment in which they learn to enable them to reach their full potential and lead happy, carefree lives.
Gem is a 19 year old Law student and has run her Full Stop 2 Bullying Campaign, counselling service and website for the past 3 years, receiving hits from all over the world. There have been 6,500 hits in the past year alone and Gemma is honoured to be an ambassador for Childline, working alongside DfES Minister Mr Ivan LEwis and anti-bullying charity Childlines' Esther Rantzen and the NSPCC.
Gemma is a positive example of how you can come through the terrible ordeal of bullying as she suffered bullying for 9 years and there were times we too thought she would never survive. We as her parents did out utmost to stop her being hurt. She has just been awarded the Community Welsh Woman of The Year for her FULL STOP 2 BULLYING campaign and we are so very proud of her strength, confidence, willpower and the courage she has to speak out and tell her story. During our first Anti-Bullying week she gave a live Sky News interview which was so well received and messages of support have been received from all over the world to her website. She has spoken at government conferences all over the country this year and I have been proud to stand by her side as her hard-hitting, but caring speech reduced many delegates at the 800 strong conferences to tears.
We are grateful to God that we have not had to face the loss of a child as you and too many other loving parents have, and applaud you in your fight to conquer bullying. Your son was such a very special, beautiful little boy and his Mum is one extra special lady. You are an example to us all, along with all the others involved in the fight against bullying which can have such a soul-destroying affect on its' victims and their families.
Good luck to you all Brenda and if we can help in any way at all please do not hesitate to ask.

With Love & Best Wishes,

Chris Lang (Gemma's Mum) &
Gemma xx

VA Director, Adrianna, on the Anti Bullying trail!

This email came in from the Bully Police - Virginia Director, Adrianna Sgarlata. Rob Bell is a State Rep from Virginia.
------------------->
This is an update on our meeting with Rob Bell.
First of all, thanks for the introduction to Rob Bell. We presented him with pictures and stories from our website and surveys and discussions with parents, and we provided him with a hard copy of a thick 3 ring binder book that we put together with tons of great resources and reference material on bullying prevention (from the Bully Police USA website.)
Surprisingly, he wanted to go into a lot of depth on what we brought to him, asking tons of questions - and I believe we were wonderfully prepared, thanks to all the legwork, research and support of our Bully Police USA founder, Brenda High.
Then we discussed the possibility of his sponsoring a bullying prevention bill this year.
The meeting started off somewhat "guarded", as he is approached by one interest group after another all day long, but by the end of our 45 minute meeting, he had completely changed around to agreeing to make this his #2 priority (he had a "small" bill he said he'd already begun working on, and that it shouldn't take very much to finish it up, and then this would become his NUMBER #1 PRIORITY for "researching" and then drafting a bill.
WOW - could have knocked me off the chair with a feather!!!
We went from one of dozens of possible "causes", or bills, to the top of the pile, all in a 45 minute meeting. (That also shocked me - I thought we'd get about 15 minutes max). At any rate, seems this topic is very near and dear to his heart and I believe your efforts and meetings with Rob laid some great groundwork, such that he was already somewhat pre-disposed to proceeding. (I feel badly that it takes a child who nearly commits suicide to get this far, but now that we're getting closer, at least it won't all be in vain).
Plus he felt more confident, I believe, that he could back up his position this time around because of the depth of research we submitted to him, including the info on the www.BullyPolice.org website. He didn't know there was a clearinghouse of info for all 50 States on bullying prevention and laws etc. We also gave him a letter from an elementary school principal who we are working with who has begun a school wide bullying prevention program. She provided some wonderful statistics:
She has implemented the Olweus Bullying Prevention Program at her school and got 5 other elementary schools in her "cluster" to do likewise. Of their 9000+ students in those schools, 2395 students in grades 3-10 answered the 36 questions on the bullying survey. Pyramid wide here are some of their findings:
. 21 % of students reported they are bullied 1-4 times per month
. 15% reported that when they are bullied it is in the cafeteria
. 19.4% said that teachers or other adults do not intervene when they
know or hear about a bullying incident
. 33.5% reported they would never interfere if they witnessed another
peer being bullied
. 10% of the student who are getting bullied, also reported they hate
school
Rob Bell said he wouldn't normally consider drafting a bill until December, but he felt it was sufficiently critical enough such that he'd do his research NOW, so that if he decided he couldn't handle it himself, we could "shop" for another bill sponsor.
He also mentioned the autonomy of Virginia School Districts and the resistance he expects to get from Educator groups. (Actually, many STATES are the same). Not at all sure how to overcome this one. We're cc:ing Brenda and maybe she or someone in Bully Police has experience overcoming this issue.
With all of our efforts, working together, I believe this just could become the year for a bullying prevention law in Virginia. It's about time.
Thanks again,

Conference Call Nov 9th

A conference call has been arraigned on November 9 at 9:00 PM Eastern time (8: PM Central, 7: PM MST, 6: PM PST) on the topic - How to get an Anti Bullying Law passed in your State, or How to make a difference for kids who have been or are bullied. It will be about an hour long. If your State already has a law, we still invite you to our Conference call because many school districts are not obeying their state law. We will teach you how to work with those school districts, helping them to obey the law. We will also have a chance to meet others around the USA who are trying to make a difference in their schools and State.

I have received confirmation, yes or no, from several people (Brenda S. IL; Libby G. ME; Jan B. CA; Marc J. MO; Renee O. MA; Maureen B. IL; Anna MO; Kathy F. FL; Donna F AZ; Officer Alessandra N. OH; Elizabeth B. CA/SC; Tamatha B. KS; Cathy S. OK; & Stan P. NV). I have only sent out the this invitation to a fraction of my email list because I wanted to give parents and activists who are passionate about solving the bullying plague first dibs. By the middle of next week, I will invite some educators and media who have shown an interest in anti bullying laws.

There must be an RSVP if you are interested at brenda@jaredstory.com

The cost will be your normal long-distance rate, plus the investment of one hour of your time.

This is the time of year that lawmakers start putting together laws. As soon as the election is over, we need to start bugging our lawmakers to move forward for the protection of bullied and abused kids.

I hope to hear from you soon.

Bully Police USA

Bully Police USA is making a difference. After talking to Les Shields, a School Board Member in Iowa, about a sexual orientation clause, which I oppose, he made a motion to create an anti bullying policy from Kennewick WA, which is posted on the www.bullypolice.org website.
~Brenda

Here is the first message:

Mrs. High,
Thank you for taking the time to call and provide your insight into the issue in Clinton, Iowa to include the words sexual orientation in our school district discrimination policies. I'm sorry that I was not at home to speak to you personally, however my wife Joanne took excellent notes of your conversation. I have spent considerable time researching your web site and the links therein.
As an interesting aside, in a letter dated Sept. 28th, the Iowa Association of School Boards announced to all Iowa districts that they were refusing to take action on a recommendation to include sexual orientation as a separate and unique protected class. The Association position was that bullying, harassment, intimidation, and discrimination against any student should be prohibited.
I thought you might be interested to see where your comments and advice has taken me in this debate. Comments and insights from your web site are liberally included and annotated. The policy I will propose is from the Kennewick, Washington School District as posted on your web site. Below is a cut and paste of my prepared comments for the next School Board meeting. That meeting is tonight, Monday 10/11/2004 at 7:00 PM CDT. I will let you know how this turns out.
Sincerely,
Les Shields, Board Member
Clinton Community School District

One of the basic concepts of a representative democracy is that we elect people to public office to represent our majority opinions. That being the case, the comments I have received over the last couple of weeks are running about 30 to 1 in support of my opinion. One can only hope that the rest of the Board has heard from many of our constituents just like I have, and more importantly, that we have listened to them.
Our Administrative staff needs policies from this Board that clearly describes acts of discrimination, bullying, harassment, and intimidation that our District will not condone. This does not require a new category of victim. There is no valid reason why a particular group needs to be identified before we can protect them from discrimination, bullying, harassment, and intimidation. I want these protections for all of our students. I had hoped this Board's action last year in approving an anti-bullying policy, as recommended by the national Safe Schools Initiative, was instructive in this area. As you may recall, the Safe Schools Initiative was the result of a study about school violence all over the country, most notably the Columbine High School incident. Following is a short summary of just a few of those incidents which prompted the Safe Schools Initiative.
School shooters: Secret service findings
October 15, 2000
Chicago Sun-Times
BILL DEDMAN STAFF REPORTER
James Alan Kearbey, 14, Goddard, Kan., Jan. 21, 1985. Killed the principal and three others in his junior high school. Said he was bullied and beaten by students for years.
Nathan Faris,12, DeKalb, Mo., March 2, 1987. Teased about his chubbiness, Nathan shot a classmate, then shot himself to death.
Toby Sincino, 16, Blackville, S.C., Oct. 12, 1995. Toby was picked on by students. A week before the shooting, he had been suspended for making an obscene gesture. He shot and wounded a math teacher, killed another math teacher, then killed himself. (Personal research revealed the bullying was because of his height – less than 5 feet tall)
Barry Loukaitis,14, Moses Lake, Wash., Feb. 2, 1996. Walked into algebra class with a hunting rifle, two handguns and 78 rounds of ammunition. Killed the teacher and two students, wounded a third. One of the students killed had teased him. (Barry: "Some day people are going to regret teasing me.")
Joseph "Colt" Todd,14, Stamps, Ark., Dec. 15, 1997. Shot two students. Said he was humiliated by teasing.
Eric Harris,17, and Dylan Klebold, 18, near Littleton, Colo., April 20, 1999. The pair killed 12 students and one teacher, wounded 23 students, and killed themselves.
"I just remember life not being much fun," a shooter recalls. "Reject, retard, loser. I remember `stick boy' a lot, 'cause I was so thin."
(End of Chicago Sun Times reference)
(These six incidents total 24 dead and 28 wounded)
None of these incidents were about race, color, gender, marital status, national origin, religion, disability, or sexual orientation. So you see, the proposal before us tonight does nothing to end the discrimination, serious bullying, harassment, and intimidation issues in our schools like what happened in the incidents I summarized here. Unfortunately, there are many more incidents like these, but not enough time in this meeting to summarize them all. It has been the statement of several Board Members that this debate is about creating a safe learning environment for ALL of our students. I would also like to publicly state that I stand with you on that issue. But the proposed policy amendment before us tonight does not accomplish that goal. What does accomplish a safe learning environment for ALL of our students is a stronger policy, with clearer definitions and procedures for addressing discrimination, bullying, harassment, and intimidation against any student and for any reason.
This debate in Clinton, Iowa has been heard coast to coast. The Clinton Herald website has a Reader's Comment from Massachusetts that attacks my earlier comments on this issue. On the other side of the U.S., I have heard from a woman in the state of Washington who supported my comments, and whose teenage son committed suicide in 1998 because of bullying at school. This woman has taken on the cause of stopping bullying, and on her website BullyPolice.org are posted several model anti-bullying policies. I will be presenting a model policy to the community and this Board tonight, and ask that the Board direct our Administration to begin the process to write this into our school district policies.
The website BullyPolice.org rates Iowa as receiving an F in addressing bullying, both from the state level and from school district level policies. I can not think of one reason why Clinton Community Schools should not be a leader in this State in stopping discrimination, bullying, harassment, and intimidation for ANY reason.
Defining the victim is like defining a particular leaf on a tree. Discrimination, bullying, harassment, and intimidation originate in the root, not in the leaf. I prefer to attack the root problem, rather than identifying individual leaves.
For these reasons, I will move to amend the current motion by striking the words "sexual orientation" and insert the words "or for any other reason". Robert's Rules of Order prohibit me from making another motion at this time. Immediately following the Board vote on the motion before us, I will follow this with a presentation to the Board and community of a new anti-discrimination, bullying, harassment, and intimidation policy, and a motion to direct Administration to prepare and present to the Board a new and stronger anti-bullying policy.
I do not condone discrimination, bullying, harassment, or intimidation against any student. But our policies MUST protect all students. Our actions need to clearly spell out our position that we desire to protect all students, which is not done by identifying another sub-group, especially one that is objectionable to the majority of our voters. No one has objections to the sub-groups as identified in our current policies. In most of these cases, I suspect the separate identifications are legally required. Such is not the case with sexual orientation as a unique sub-group.
In closing, I would like to address those of you in the audience, and those watching our meeting at home on television. In just a few minutes this Board is going to vote on the motion before us. I want each and every one of you to know, that regardless of how each Board Member votes tonight, every one of these Members have one overriding theme in mind. It is "What is best for our students?" When we leave this meeting tonight, we will still all be friends. I ask you to also accept the majority vote, no matter which way this vote goes.
Mr. President, I move to amend the motion by striking the words "sexual orientation" and after the word "disability" insert the words "or for any other reason".

Here is the 2nd message:

Mrs. High,
I trust you received my previous message containing the comments I had prepared for the Clinton Community Schools Board Meeting. I presented those comments during the discussion on the (previous) motion to include sexual orientation in our harassment policy. The motion passed 6 - 1 (I voted No).
The Board did unanimously agree to accept the proposed anti-bullying policy from Kennewick Schools that I presented. The policy was referred to our administration, with a plan to discuss it at our Committee of the Whole meeting the end of this month, and for Administration to report back with a proposal no later than our December meeting. I am hopeful that Clinton Community Schools will be the first district in Iowa to receive better than an F from your organization.
Thanks again for your support and advice.

Another note from Brenda

I totally agree - All children need to be protected from bullies and no victim of a bully is more important than another. To define victims is wrong because any child can be victimized by a bully. We must stop the bully from bullying - thus we stop their targets from becoming victims.
